Mediation is a process where a trained third party neutral facilitates discussions with the objective of assisting parties with competing interests in litigation or potential litigation to reach a mutually acceptable resolution. Mediation is an effective way to resolve disputes in a non-adversarial setting.
Mediation can be a valuable alternative to litigation for Elder and Disability Law Attorneys to offer clients involved in family disputes such as contested Guardianships, estate matters and second marriage situations where one spouse may need institutional care or other assistance with activities of daily living. Mediation can be particularly effective in disputes where one party either receives or anticipates receiving government benefits such as Medicaid, or in divorce situations where a party or a child of the marriage is disabled and government benefits may be anticipated.
There are many advantages to mediation. Disputes are resolved in a timely manner and in a far more cost effectively than litigation. More importantly, mediation often maintains family relationships that can be irreparably harmed during litigation.
Gene Rosner is an accredited Mediator who brings over twenty-five years experience to his mediation practice. He received his mediation training from the Seton Hall University School of Law Institute for Dispute Resolutions and obtained the peer reviewed designation as an Accredited Mediator from the New Jersey Association of Professional Mediators, an organization which he was a founding member and for which he served as President.
Gene also has extensive experience as an Elder and Disability Law Attorney, and as a Family Law Attorney. He received the designation of a Certified Elder Law Attorney from the National Elder Law Foundation, a certifying organization approved by the New Jersey Supreme Court.
Gene served as a Panelist for the Union County Early Settlement Programs in the Family and Probate Courts where he helped to resolve countless litigation matters. He has successfully mediated numerous cases in his practice, effectively using his skills as a Mediator and his extensive experience as an attorney by offering creative options for settling disputes.
